States with waived areas

H.R. 1 allows waivers only where unemployment is over 10% (or, in Alaska and Hawaii, at least 1.5 times the national rate). USDA said it expects very few areas to qualify. These states had approved waivers in effect on October 1, 2026:

Waivers usually last 12 months and can end early. Check your state page and ask your SNAP office before relying on one.

How states set the 36-month period

Most states that publish their dates use one fixed period for everyone, such as January 2025 to December 2027 (Alabama, North Carolina, Oregon, Tennessee, West Virginia, Wisconsin) or January 2026 to December 2028 (California). Others, including Texas, North Dakota, New Hampshire and Oklahoma, give each person their own clock. Use the time limit calculator with your state selected.

Frequently asked questions

Which states have SNAP work requirement waivers in 2026?

As of October 1, 2026, USDA lists partial waivers in Alaska, Arizona, California, Kentucky, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Wisconsin. No state has a statewide waiver.

Why did my state start later than others?

States had to update computer systems, notices and training. Some also had existing waivers that ran until they expired, and a federal court case in late 2025 kept some waivers in place into early 2026.

Can my state choose not to follow the new rules?

No. The time limit is federal law. States can choose how to track the 36 months, use discretionary exemptions, and decide how strictly to verify hours, but they cannot drop the rule.

What if my state page says "not published"?

It means we could not find that detail on an official state website. The federal rules still apply. Call your SNAP office and ask for the date, your 36-month period, and how to report hours.

Do the rules apply in Puerto Rico?

No. Puerto Rico, American Samoa and the Northern Mariana Islands use a nutrition block grant instead of SNAP. Guam and the U.S. Virgin Islands run SNAP, so the time limit applies there.
